Contract

I know--contracts are scary laywer stuff.  But this one is simple, really!  It lets you know exactly what to expect from me.  And it allows me to use whatever supplies I need without contacting the manufacturer.  I promise it won't bite!

I, as the client, agree to the following conditions:

1.      I will provide photographs and memorabilia to Designs of Mine by Kelly Marshall for inclusion in the commissioned album.  These photographs will be mounted using only adhesives, paper, etc. that will not damage my items.  If I should provide poor-quality photos or clippings causing “acid bleed” etc., Designs of Mine will not be held responsible.  I will inform her if my photos are irreplaceable and have no negatives.

2.      I understand the items I present to Designs of Mine will be stored in a safe environment and every precaution taken to insure their safety.  I will not hold Designs of Mine responsible for fire, floods, hurricanes, tornadoes, or other unavoidable disaster (including theft or auto accident) resulting in damage to my property.  In the event my property is damaged, Designs of Mine is liable only for the cost of reprinting photos.

3.      I will inform Designs of Mine of photos or memorabilia that I do not want permanently affixed to the album page.  These items will be mounted using photo-safe corners for easy removal.  These photos will be labeled as such or included in a separate envelope.  I understand removing permanently affixed photos may result in damage to photos.

4.      Designs of Mine has my permission to crop any of the items I’ve presented to her to facilitate placement and balance.  Those I do not wish altered have been so marked.

5.      A half-down deposit will be required up front to purchase the album(s), supplies, etc.  As materials will be purchased with this money, it is nonrefundable.  The balance will be due upon completion and satisfactory acceptance of the album and its contents.

6.      All shipping charges, if applicable, are included in the bid.  Designs of Mine will take full responsibility for choosing a reputable carrier and purchasing adequate insurance with proof of delivery required.  In the event of a mistake by the carrier, the burden of replacement and damages will fall upon the agent.

7.  Designs of Mine wishes for my complete satisfaction of the finished work.  If I am not satisfied, I understand I may return the album within 7 days from date of delivery for adjustments.  I understand that if the project is mailed back I am solely responsible for postage and insurance. Any changes added after the completed album(s) is delivered are subject to additional charges, if these fall outside the range of original concept.
